Welcome to MAD5 Fitness LLC, DBA The Maddison Fitness Facility (“The Maddison Fitness Facility,” “TMF,” “we,” “us,” or “our”). These Terms and Conditions govern your use of our facilities, services, and website (the “Services”). Facility Rules and Prohibited Activities

All members and visitors are required to adhere to TMF's rules for the safety and enjoyment of everyone. Prohibited activities include:

• Damaging, tampering with, or misusing gym equipment.

• Engaging in unsafe, disruptive, or inappropriate behavior.

• Posting or transmitting offensive, defamatory, or harmful content in connection with TMF services or facilities.

• Using the facility for unauthorized commercial purposes or solicitation.

Copyright and Intellectual Property Copyright

• All content, software, and technology used by MAD5 Fitness LLC, DBA The Maddison Fitness Facility are the property of TMF or its licensors and are protected by copyright laws.

• Users are granted permission to view and use the content for personal, non-commercial purposes only. Reproduction or distribution without authorization is strictly prohibited.

Trademarks

• TMF trademarks, logos, and branding may not be used without prior written consent. Unauthorized use will be subject to legal action.

Liability Waiver

• By using TMF’s services, you voluntarily assume all risks of personal injury, property loss, or damages.

• TMF shall not be liable for injuries, damages, or losses unless caused by gross negligence or intentional misconduct.

• Members are encouraged to consult with a physician before beginning any fitness program.

Payments, Cancellations, and Refunds Payments

• You authorize MAD5 Fitness LLC, DBA The Maddison Fitness Facility and any payment processing provider engaged by TMF to charge your credit card or process payment through any other means for services or products purchased.

• You represent and warrant that you are the authorized user of the payment method used and are responsible for all transactions made under your name.

• Payments made to TMF are non-refundable unless specified in the membership agreement.

Cancellation Policy

• Memberships may be canceled with prior written notice in accordance with the terms outlined in the membership agreement.

• Refunds, if applicable, will be processed per the stated cancellation terms.

Dispute Resolution Arbitration Clause

• All disputes, claims, or controversies related to these terms will be resolved through binding arbitration under the rules of the American Arbitration Association.

• Arbitration will occur in South Carolina, and each party will bear its costs unless otherwise awarded by the arbitrator.

Class Action Waiver

• Members agree to resolve disputes on an individual basis and waive the right to participate in class actions.

Small Claims Exception

• Claims qualifying for small claims court may be pursued in South Carolina small claims court.

Continued Operation, Accessibility, and Maintenance

MAD5 Fitness LLC, DBA The Maddison Fitness Facility reserves the right to modify, suspend, or terminate the operation of its website or services at any time, with or without prior notice. TMF also reserves the right to refuse service to any individual at any time, with or without cause.

Your Account

• If you register for an account on our website, you are responsible for maintaining the confidentiality of your username and password.

• You agree to accept full responsibility for all activities that occur under your account.

• TMF reserves the right, without notice, to restrict access, terminate accounts, or edit or remove content at its discretion.

Data Use for Employees, Trainers, and Contractors

This section applies only to employees, trainers, or contractors with access to Member Data:

• Access to Member Data is granted solely for assisting members in their use of TMF’s services.

• You must take reasonable steps to prevent unauthorized access or exposure of Member Data.

• Unauthorized disclosure of Member Data is strictly prohibited and may result in legal action.

• If Member Data is exposed or disclosed without proper authority, you may be held liable for losses incurred by TMF or affected members due to your negligence or intentional acts. 

Disclaimers and Limitation of Liability Disclaimer of Warranties

• MAD5 Fitness LLC, DBA The Maddison Fitness Facility provides all services, facilities, and website content "as is," without any warranties, whether express or implied.

• TMF does not guarantee error-free, uninterrupted, or secure access to its website or services.

Limitation of Liability

• Under no circumstances whatsoever shall MAD5 Fitness LLC, DBA The Maddison Fitness Facility’s aggregate liability resulting from or relating to your use of the facilities, services, or website exceed Five Dollars ($5.00).

Indemnification

You agree to indemnify, defend, and hold MAD5 Fitness LLC, DBA The Maddison Fitness Facility, its successors, and assigns harmless from and against any and all third-party claims, demands, losses, costs, expenses, obligations, liabilities, damages, recoveries, and deficiencies, including interest, penalties, and reasonable attorneys’ fees incurred by TMF which arise from or relate to:
